Last Update: April 04, 2026

These Terms of Service (“Terms”) constitute a legally binding agreement between Measurable (“Measurable,” “we,” “us,” or “our”) and you (“User,” “you,” or “your”) regarding your access to and use of the website https://measurableapp.com and the associated web-based SaaS platform (collectively, the “Service”). The Service is an AI-powered marketing report generator that enables marketing agencies, business owners, and individuals to upload marketing data (such as CSV or Excel files), connect third-party integrations including Meta (Facebook) Pages and Ads, and automatically generate professional marketing reports using artificial intelligence.

By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

These Terms govern your use of the Service. We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on our website and, where feasible, by email. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service.

2. Description of the Service

Measurable provides a platform that allows users to upload their own marketing data files, securely connect authorized third-party data sources such as Meta Facebook Pages and Ads accounts, and leverage artificial intelligence to analyze the data and generate automated, client-ready marketing reports. The Service includes account management, data processing, report generation, storage of user-uploaded content, and related support features. The Service is provided on a subscription basis or as otherwise offered on our pricing page.

The Service also supports Instagram Business account integrations and analytics retrieval through Meta APIs for the purpose of generating automated Instagram performance reports.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements. The Service is intended for business and professional use by marketing agencies, business owners, and individuals acting in a commercial capacity. Use by individuals under 18 or for personal, non-commercial purposes not aligned with the Service’s intended function is prohibited.

4. User Accounts and Responsibilities

To access certain features of the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You are solely responsible for all data and content you upload, connect, or input into the Service (“User Content”), including ensuring that you have all necessary rights, consents, and permissions to provide such data.

5. Acceptable Use Policy

You agree not to, and not to permit others to:

- Use the Service for any illegal, fraudulent, or unauthorized purpose.

- Upload, transmit, or introduce viruses, malware, or other harmful code.

- Scrape, crawl, or use automated means to access the Service without our prior written consent.

- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service or any part thereof.

- Interfere with or disrupt the Service or servers or networks connected to the Service.

- Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to investigate violations of this Acceptable Use Policy and to suspend or terminate your access to the Service for any violation.

6. Integration with Third-Party Services

The Service may allow you to connect and integrate with third-party services, including Meta (Facebook) Pages and Ads via official APIs. When you authorize such connections, you grant us permission to access the data permitted by the scopes you approve.

You are solely responsible for complying with all terms, policies, and agreements of any third-party service you connect, including Meta’s Platform Terms, Developer Policies, Terms of Service, and any applicable advertising or data use policies. We are not responsible for any actions, data practices, or changes made by third-party service providers. You acknowledge that your use of third-party integrations is at your own risk and that we may be required to modify or discontinue certain integrations due to changes in third-party policies.

Certain integrations and features depend on the availability and policies of third-party platforms, including Meta. We do not guarantee continuous availability of any third-party API or integration.

7. User Data and Content

You retain all ownership rights in your User Content, including data you upload and marketing information you provide. By uploading or connecting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to access, use, process, reproduce, format, display, and analyze such User Content solely as necessary to provide the Service to you, generate reports, improve and maintain the Service in anonymized and aggregated form where appropriate, and comply with legal obligations.

You represent and warrant that your User Content does not infringe any third-party rights and that you have obtained all necessary consents for any personal or Meta Platform data included in your User Content.

8. Intellectual Property

The Service, including its software, AI models, user interface, design, logos, trademarks, and all underlying technology, is owned by Measurable or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights expressly granted to you under these Terms, no other rights are granted.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service during the term of your subscription, solely for your internal business purposes. AI-generated reports and outputs (“Outputs”) are provided to you for your use; however, we retain ownership of the underlying AI models, algorithms, and any general know-how. You may use the Outputs for your business purposes but may not resell, redistribute, or claim ownership of the AI technology itself.

9. Payments and Subscription Terms

Certain features of the Service require payment of subscription fees. Fees are billed on a recurring basis (monthly or annually, as selected). All payments are non-refundable except as expressly provided in our cancellation policy or as required by applicable law.

You authorize us or our payment processor to charge your chosen payment method for all applicable fees. Subscriptions automatically renew unless cancelled in accordance with our cancellation procedures. We may change pricing upon notice, and continued use after a price change constitutes acceptance of the new fees. Late payments may result in suspension of your account. Taxes are additional and your responsibility unless otherwise stated.

We offer no refunds for partial months or unused portions of a subscription unless otherwise specified on our pricing page or required by law.

10. Termination

You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access to the Service, with or without notice, for any reason, including breach of these Terms, non-payment, or to protect the integrity of the Service. Upon termination, your right to use the Service ceases immediately, and we may delete your account and associated data subject to our Privacy Policy and any legal retention obligations. Sections that by their nature should survive termination will continue to apply.

11. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any reports, insights, or AI-generated Outputs. Marketing data analysis and AI outputs are provided for informational purposes only and should not be relied upon as professional, financial, or legal advice. You are solely responsible for verifying the accuracy of any Outputs and for any decisions made based on them.

We do not guarantee the accuracy, completeness, or continued availability of data provided by third-party platforms such as Meta.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall Measurable, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or related to these Terms or the Service, even if advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under these Terms or your use of the Service shall not exceed the total amount actually paid by you to us for the Service in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

13. Indemnification

You agree to indemnify, defend, and hold harmless Measurable, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use of the Service; (ii) your User Content; (iii) your violation of these Terms or any third-party rights, including Meta’s terms and policies; or (iv) your breach of any representations or warranties made by you.

By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy, the Privacy Policy shall control with respect to data privacy matters.

15. Data Usage with Meta APIs

When you connect your Meta (Facebook) accounts, we access data solely through official Meta APIs and only with your explicit authorization. Any data obtained from Meta is used exclusively to provide the report-generation functionality you request and in strict compliance with Meta’s Platform Terms, Developer Policies, and all applicable data-use restrictions. We do not sell, rent, or use Meta data for any purpose unrelated to fulfilling your specific requests. You remain responsible for ensuring your use of Meta data complies with Meta’s requirements.

16. Modifications to the Service or Terms

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service. Continued use of the Service following any modification constitutes your acceptance of the changes.
